It also plays a significant role in the regulation of ships operating under India&#8217;s authority and the ones entering Indian coastal waters.&nbsp;<\/p>\n\n\n\n<p>It makes sure that the first responders respond actively to any pollution incidents that threaten India\u2019s coast. To further understand the classification of the ships and other things, here are the definitions of certain terms that are deemed crucial:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Harmful substance &#8211; Any substance or form of energy which causes hazards to any form of living organism (Both human and marine life) when released into the sea or air.<br><\/li>\n\n\n\n<li>Dumping &#8211; The act of deliberately throwing waste into the sea, whether it be general waste, metallic waste or abandoned ships and their parts. However, this definition does not consider disposal of normal operational waste (after proper procedures) as dumping and other allowed placements under international rules.<br><\/li>\n\n\n\n<li>Port &#8211; includes port facility, shipyard, ship breaking yards,ship repair unit, offshore facilities and terminals.<br><\/li>\n\n\n\n<li>Vessel &#8211; Any form of vessel floating\/operating on sea. It can be ships, boats, floating platforms, oil storage units or floating production units.<\/li>\n<\/ol>\n\n\n\n<p>And along with laws for pollution there\u2019s also laws for <a href=\"https:\/\/www.indosearch.in\/learn\/vessel-safety-and-security-ms-act-2025\/\">vessel safety and security as per MS, Act 2025<\/a> that affect the units as mentioned above.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"rules-for-ships-on-pollution-prevention-and-following-international-law\">Rules for ships on pollution prevention &amp; following international law. <\/h2>\n\n\n\n<p>Each and every vessel is mandated to prevent the discharge of harmful substances into the sea and advised to be built\/equipped properly to avoid pollution while following the construction and safety standards. This helps the central government effectively implement these laws and regulate marine operations in order.&nbsp;<\/p>\n\n\n\n<p>The government can and has the power to designate special pollution sensitive areas which ships will have to avoid or be mindful of operations around these areas. The authorities also have the right to only allow certain materials to be disposed of into the sea or completely ban dumping at all cases until exempted.&nbsp;<\/p>\n\n\n\n<p>Ships must comply with international pollution treaties like:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>MARPOL (Marine pollution prevention)<br><\/li>\n\n\n\n<li>Anti-Fouling Systems Convention<br><\/li>\n\n\n\n<li>Ballast Water Management Convention<br><\/li>\n\n\n\n<li>Oil Pollution Intervention Convention<br><\/li>\n\n\n\n<li>Any other pollution treaty India joins<\/li>\n<\/ul>\n\n\n\n<p>To add to this the state of the vessel depending on whether it&#8217;s old, new, small or big effects and plays a pivotal role in contributing to the risk of pollution. Hence, it&#8217;s important to learn about <a href=\"https:\/\/www.indosearch.in\/learn\/vessel-age-impacts-safety-pollution-risk\/\">how the vessel age impacts safety, pollution control and Insurance risk.<\/a><\/p>\n\n\n\n<p>If any ship (foreign) is not mandated to follow these rules from the treaties mentioned above. They will have to follow the general rules for pollution prevention as prescribed. And all ships will have to carry around certifications and documents depending on the type, size, nature and area of operation of the vessel<\/p>\n\n\n\n<p>While these rules are for vessels, it&#8217;s important to learn about the <a href=\"https:\/\/www.indosearch.in\/learn\/rights-and-rules-for-seafarers-under-ms-act-2025\/\">rights and rules for seafarers<\/a> to be a more efficient and promising member of staff at sea.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"pollution-prevention-certificates-record-books-authority-powers\">Pollution prevention certificates, record books &amp; authority powers.&nbsp;<\/h2>\n\n\n\n<p>No ship\/vessel is allowed to sail without the certificates of pollution prevention by the treaties mentioned in the previous section and they must always have them onboard.&nbsp;<\/p>\n\n\n\n<p>Authorities at any point or time can board the ships to inspect the presence and validity of these certificates and if they identify the certificate as invalid then they have the rights to:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Detain the ships or&nbsp;<\/li>\n\n\n\n<li>Stop the ships from sailing any further.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Indian ships in particular have been advised to maintain record books to keep track of oil discharges, waste disposal, sewage handling and ballast water operations to ensure or secure proof of the proper waste management. These can be both surveillance systems and enforcement systems.&nbsp;<\/p>\n\n\n\n<p>With systems and rules for pollution control to protect marine life, they also have many more to prevent harm to human life onboard, like the <a href=\"https:\/\/www.indosearch.in\/learn\/stwc-2025-mandatory-harassment-prevention-training\/\">STWC mandatory harassment prevention training<\/a> that helps reduce bullying or sexual harassment for workers at sea.&nbsp;<\/p>\n\n\n\n<p>There will be official analysts appointed who will Investigate pollution incidents, analyze samples and provide technical findings that advance the pollution prevention process along with the inspection process.<br><\/p>\n\n\n\n<p>Ports must and are mandated to provide facilities where ships can&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Safely dispose waste&nbsp;<\/li>\n\n\n\n<li>Collect and treat waste&nbsp;<\/li>\n\n\n\n<li>Follow international pollution rules&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>They are allowed to charge the ships a reasonable amount for using these facilities and if they fail to provide the said facilities then they can be penalized as punishment for the lack of co-operation.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"rule-making-powers\">Rule making powers.&nbsp;<\/h2>\n\n\n\n<p>According to this part of the act the central government is allowed to make\/implement rules on the following matters:&nbsp;<\/p>\n\n\n\n<p>(a) the manner of providing equivalence or granting exemption to any vessel or person.<\/p>\n\n\n\n<p>(b) other substances which fall within the definition of &#8220;harmful substances&#8221;.<\/p>\n\n\n\n<p>(c) the equipment and requirements and conditions relating to construction, survey of equipment and structure of vessel.<\/p>\n\n\n\n<p>(d) the pollution prevention standards and requirements for designated areas.<\/p>\n\n\n\n<p>(e) the form, duration and conditions subject to which a certificate may be granted.<\/p>\n\n\n\n<p>(f) the manner of obtaining permission for dumping in coastal waters.<\/p>\n\n\n\n<p>(g) the conditions subject to which the vessel shall comply with the conventions, agreements or treaties specified before. Including any other pollution prevention convention or agreement or treaty to which India is a party and the pollution prevention requirements to be complied with by the vessels on which conventions, agreements or treaties do not apply<\/p>\n\n\n\n<p>(h) the types of certificates and documents.<\/p>\n\n\n\n<p>(i) the manner of inspection of certificates by a surveyor.<\/p>\n\n\n\n<p>(j) the form and manner of maintenance of record books and the nature of entries to be made in the books of record, the custody and disposal thereof, and other matters relating to maintenance of record books.<\/p>\n\n\n\n<p>(k) the particulars of the incident, the authority and the manner of reporting the incident.<\/p>\n\n\n\n<p>(l) the measures to be taken by the Central Government for the monitoring, detection and control of pollution.<\/p>\n\n\n\n<p>(m) the reception facilities, surveillance, supervision and guidance.<\/p>\n\n\n\n<p>(n) any other matter which is required to be or may be prescribed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"conclusion\">Conclusion&nbsp;<\/h2>\n\n\n\n<p>This part of the act\/ law shows how crucial and dangerous India considers marine pollution to be.
